Products Liability

Defective and unreasonably dangerous products can cause serious injuries to adults as well as children.  Manufacturers of products have a duty to design, manufacture, and market their goods in a manner that will not unreasonably result in injury to the intended user of the product.  A product that is unreasonably dangerous is one whose danger the consumer does not expect or whose risks outweigh its benefits.

Most products liability claims arise where a product, when being used properly, malfunctions or breaks, and causes injuries to the user or an innocent bystander.  This can occur in nearly any type of product.  Our attorneys have successfully handled product liability cases involving a wide array of products, including faulty heavy equipment/machinery, inoperable automobile air bags, industrial shelving, and even a defective wine bottle.

It is not uncommon for a claim to exist where a product is designed and warranted to perform in a particular manner but due to a defect in the design or a manufacturing defect the intended user was seriously injured.  In many cases the injury could have been avoided had the manufacturer utilized a safer alternative design in order to avoid a foreseeable risk of injury.  A manufacturing defect occurs when the product is improperly or negligently made.  Poor manufacturing can result in serious defects that can make a product that is safely and properly designed a hazardous product. This can occur when a manufacturer uses the wrong materials or fails to implement appropriate quality controls prior to distributing the product to the public.

A manufacturer of a product has a duty to warn a potential user of the inherent dangers the product may possess.  If the manufacturer fails to warn of those possible dangers or instruct the user on the proper use they may be held liable for any injuries which occur as a result. A product that is safe when the consumer knows how to use it can become dangerous without the proper warnings or instructions. The manufacturer has a duty to warn users of the non-obvious aspects that can make the product dangerous.

If you have been hurt by a defective or unreasonably dangerous product, seek the help of an experienced products liability attorney.  It is important that you retain the product that caused the injuries as it may be necessary to have the product examined by an expert in order to prove your claim.  It will be much easier to prove what kind of defect caused the problem.  Please contact our office for a consultation so you can speak directly with a knowledgeable products liability attorney.
